Convicted sex offender arrested for living close to daycare center

MIDDLEBURG – A registered sex offender was arrested after the Clay County Sheriff’s Office said he violated the terms of his probation for a second time.

Shawn Alan Bair was arrested on July 29 and charged with eight sex offender violations – two counts of living within 1,000 feet of a daycare facility, four counts of failing to report an established transient residence, failure to register as a sexual predator and failure to report vacating residence.

A deputy viewed the database “Offenderwatch,” which maintains records on sexual predators, offenders and career offenders in Clay County. He noticed Bair hadn’t checked in with his counselor for four months. He also saw Bair listed his transient address as the intersection of Atlantis and Challenger drives.

The deputy went to that intersection multiple times and didn’t find Bair’s vehicle or Bair. He then went to Bair’s mother’s home and found Bair. He said Bair admitted he had been staying with her. The mother’s house was 652 feet from a daycare center.

Bair was convicted in 1998 of capital sexual battery for molesting a 5- or 6-year-old boy while he was a high school senior.

He pled guilty and was sentenced to 12 years, but he was released on his own recognizance and placed on probation after serving 694 days. Part of his probation stipulated he was not allowed to leave the county without permission from his probation officer, he couldn't be within 1,000 feet of a school, daycare center or a playground, he had a curfew between 10 p.m. and 6 a.m., and he was prohibited from having any contact with children 8 and younger without notifying the responsible adult of his crime. The adult is to be approved by the court.

He was arrested again in October 2011 after he admitted to driving his girlfriend and a friend’s daughter to an off-road mud run in Bradford County without notifying the probation officer or a responsible adult. He was sentenced to 14 years but served less than half of that sentence.

Bair is in the Clay County Jail with a $350,024 bond. His next court appearance is Aug. 27.
