NOTICE OF RULEMAKING BY THE FLEMING ISLAND PLANTATION COMMUNITY DEVELOPMENT DISTRICT

A public hearing will be conducted by the Board of Supervisors (“Board”) of the Fleming Island Plantation Community Development District (“District”) on May 23, 2023, at 6:00 p.m., at Fleming Island Plantation Splash Park, 1510 Calming Water Drive, Fleming Island, Florida 32003.
In accord with Chapters 190 and 120, Florida Statutes, the District hereby gives the public notice of its intent to adopt its amended Amenity Rates (“Amended Amenity Rates”) which govern the operation of the District’s amenity facilities and other properties.
The purpose and effect of the Amended Amenity Rates is to provide for efficient and effective District operations of the District’s amenities facilities and properties by setting policies, regulations, rates and fees to implement the provisions of Section 190.035, Florida Statutes. Prior Notice of Rule Development was published in Clay Today on Thursday, April 13, 2023.
The Amended Amenity Rates will address certain revisions to the District’s Rates and policies governing the operation of the District’s amenity facilities and other properties. Proposed rates include:
Amenity Center
Amenity Center Pavilions $26-44 per pavilion (4 hours)
$225-375 Deposit Patrons are required to rent both pavilions if 10 or more in attendance
Amenity Center Pool Party $63-107 (2 hours)
$225-375 Deposit Maximum of 20 guests; reservation includes use of outside picnic pavilion
Splash Park Grounds
Splash Park Gathering Room $112-188 (2 hours)
$202-338 (4 hours)
$225-375 Deposit Maximum of 100 guests
Splash Park Playground Pavilions $26-44 per pavilion (4 hours)
$225-375 Deposit Patrons are required to rent both pavilions if 10 or more in attendance
Splash Park Field $70-85 (2 hours)
$225-375 Deposit
Specific legal authority for the rule includes Sections 190.035(2), 190.011(5), 190.012, 120.54, 120.69 and 120.81, Florida Statutes.
Any person who wishes to provide the District with a proposal for a lower cost regulatory alternative as provided by Section 120.541(1), Florida Statutes, must do so in writing within twenty-one (21) days after publication of this notice.

This public hearing may be continued to a date, time, and place to be specified on the record at the hearing. If anyone chooses to appeal any decision of the Board with respect to any matter considered at a public hearing held in response to a request for such a public hearing, such person will need a record of the proceedings and should accordingly ensure that a verbatim record of the proceedings is made which includes the testimony and evidence upon which such appeal is to be based.
One or more Supervisors may participate in the public hearing by telephone. At the above location, if a public hearing is requested, there will be present a speaker telephone so that any interested party can attend the public hearing at the above location and be fully informed of the discussions taking place either in person or by speaker telephone device.
