NOTICE OF PUBLIC HEARING

The Board of County Commissioners of Clay County, Florida, will hold a public hearing Tuesday, February 14, at 5:00 p.m. or as soon thereafter as can be heard, in the Board of County Commissioners Meeting Room on the Fourth Floor of the Clay County Administration Building, 477 Houston Street, Green Cove Springs, Florida, to consider the adoption of an ordinance bearing the following title:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF CLAY COUNTY, FLORIDA, RELATING TO ARTICLE IV OF CHAPTER 16 OF THE CLAY COUNTY CODE, BEING THE CODIFICATION OF CLAY COUNTY ORDINANCE 03-30, AS AMENDED, RELATING TO PUBLIC SCHOOL IMPACT FEES BY AMENDING THE FOLLOWING SECTIONS: SEC. 16-60 TO ADD AND REVISE FINDINGS PERTAINING TO THE CURRENT IMPACT FEE STUDY; SEC. 16-61 TO REVISE, ADD AND DELETE CERTAIN DEFINITIONS; SEC. 16-63 TO REVISE (b), (f) AND (g) CONCERNING THE COUNTY OFFICIAL MANAGING EXEMPTIONS, AND (d) TO ADD SUB-SECTION (7) CONCERNING AFFORDABLE HOUSING EXEMPTION, AND TO ADD SUB-SECTION (8) CONCERNING BURDEN OF APPLICANT TO PROVE EXEMPTION; SEC. 16-64 TO REVISE (a) CONCERNING SCHOOL IMPACT FEE RATES, AND (c) CONCERNING COUNTY OFFICIAL INTERPRETING FEES; SEC. 16-65 TO CLARIFY THE DATE AT WHICH THE FEE IS SET; SEC. 16-66 TO REVISE (a), (b), (c), (d) AND (e) CONCERNING THE COUNTY OFFICIAL MANAGING CREDITS; SEC. 16-67 TO CLARIFY THE ANNUAL REPORTING FORM IN (d); SEC. 16-70 TO REVISE THE DATE FOR REVIEW OF SCHOOL IMPACT FEE SCHEDULE AND THE COUNTY OFFICIAL TO BE CONSULTED; ADOPTING THE CURRENT IMPACT FEE STUDY; PROVIDING FOR SEVERABILITY; PROVIDING THAT THE ORDINANCE SHALL NOT ALTER, IMPAIR OR AFFECT PRIOR CREDIT AGREEMENTS; AND PROVIDING AN EFFECTIVE DATE.
All interested persons are invited to attend the public hearing and be heard by the Board on matters pertaining to the ordinance. Pursuant to Section 286.0105, Florida Statutes, a person deciding to appeal any decision made by the Board with respect to any matter considered at the meeting or at any subsequent meeting to which the Board has continued its deliberations is advised that such person will need a record of all proceedings and may need to ensure that a verbatim record of all proceedings is made, which must include the testimony and evidence upon which the appeal is to be based. A copy of the proposed ordinance may be inspected by members of the public at the County Attorney’s Office, Second Floor of the Clay County Administration Building, 477 Houston Street, Green Cove Springs, Florida, between the hours of 8:30 a.m. and 4:30 p.m., Monday through Friday, with the exception of legal holidays.
