NOTICE OF PROPOSED CHANGE TO THE CLAY COUNTY LAND DEVELOPMENT CODE

THE PUBLIC IS HEREBY NOTIFIED that the Planning Commission of Clay County, Florida, will hold a public hearing on Thursday, July 6, 2023, at 5:00 p.m., or as soon thereafter as can be heard, and that the Board of County Commissioners of Clay County, Florida, will hold two public hearings, one on Tuesday, July 11, 2023 at 5:00 p.m. or as soon thereafter as can be heard, and one on Tuesday July 25, 2023 or as soon thereafter as can be heard. The hearings will be held in the BCC Meeting Room, 4th Floor, Clay County Administration Building, 477 Houston St, Green Cove Springs, Florida. The proposed ordinance is entitled:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF CLAY COUNTY, FLORIDA, AMENDING ARTICLE III OF THE CLAY COUNTY LAND DEVELOPMENT CODE, BEING THE CODIFICATION OF ORDINANCE NO. 93-16, AS SUBSEQUENTLY AMENDED, AND COMPRISING THE ZONING AND LAND USE PROVISIONS, BY AMENDING IN ITS ENTIRETY SUBSECTION (b) OF SEC. 3-40 CONCERNING USES PERMITTED IN PRIVATE SERVICES (ZONE PS-3); BY AMENDING IN ITS ENTIRETY SUBSECTION (c) OF SEC. 3-40 CONCERNING CONDITIONAL USES IN PRIVATE SERVICES (ZONE PS-3); BY FURTHER AMENDING ARTICLE III BY CREATING A NEW SEC. 3-41.2 ESTABLISHING A NEW ZONING DISTRICT DESIGNATED AS PRIVATE SERVICES (ZONE PS-6), AND PROVIDING USES PERMITTED, CONDITIONAL USES, USES NOT PERMITTED, AND SETTING FORTH RULES APPLICABLE THERETO GOVERNING SITE DEVELOPMENT PLANS, DENSITY REQUIREMENTS, LOT AND BUILDING REQUIREMENTS, LIGHTING REQUIREMENTS AND ROADWAY AND SIZE LIMITATIONS; AND BY AMENDING SEC. 3-9 OF ARTICLE III PERTAINING TO ZONING DISTRICT AND LAND USE CATEGORY CONSISTENCY TO PROVIDE FOR THE INCLUSION OF THE PRIVATE SERVICES (PS-6) ZONING DISTRICT WITHIN THE AGRICULTURE LAND USE CATEGORY, THE AGRICULTURAL/RESIDENTIAL LAND USE CATEGORY, THE RURAL RESIDENTIAL LAND USE CATEGORY, THE RURAL FRINGE LAND USE CATEGORY, THE URBAN FRINGE RESIDENTIAL LAND USE CATEGORY, THE URBAN CORE (10) RESIDENTIAL LAND USE CATEGORY, THE URBAN CORE (16) RESIDENTIAL LAND USE CATEGORY, THE COMMERCIAL LAND USE CATEGORY, THE INDUSTRIAL LAND USE CATEGORY, AND THE INDUSTRIAL PARK LAND USE CATEGORY; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
Interested parties may appear at the hearings and be heard with respect to the proposed ordinance. After the public hearings the Board may take immediate action on the proposed ordinance, or may continue its deliberations to a date, time and place then announced without publishing further notice thereof. A copy of the proposed ordinance is available for inspection by the public at the Clay County Planning and Zoning Division, Third Floor of the Administration Building, between the hours of 8:30 a.m. and 4:30 p.m., Monday through Friday, excluding legal holidays.
Pursuant to Section 286.0105, Florida Statutes, a person deciding to appeal any decision made by the Board of County Commissioners with respect to any matter considered at the hearings or at any subsequent hearing to which the Board has continued its deliberations is advised that such person will need a record of all proceedings and may need to ensure that a verbatim record of all proceedings is made, which must include the testimony and evidence upon which the appeal is to be based.
