Man wanted for kidnapping daughter arrested in Jacksonville

JACKSONVILLE – A man who triggered an Amber Alert after his eight-month-old daughter was taken on Feb. 16, was arrested by the Jacksonville Sheriff’s Office on March 1 and returned to Clay County on April 25 to face interference with custody and kidnapping charges.
Terry Aries Levy, 46, will remain in the Clay County Jail without bond.
Paradise Levy was reported missing near Stoneyhill Way. According to the alert, her father, who reportedly has no custodial rights, was seen leaving the area near the abduction near Youngerman Circle.
The girl’s aunt called deputies to tell them the child was dropped off at her house later that day.
Levy’s arraignment will be May 9.

Middleburg man convicted of Green Cove Springs murder

GREEN COVE SPRINGS – A Middleburg man faces a possible life sentence after a Clay County jury found him guilty on April 28 of second degree murder and armed robbery after a planned ambush left one of the attackers dead.
Daveion Breshod Austin, 23, will be sentenced on July 5 after the jury agreed he masterminded the robbery of three men who thought they were buying guns. One of Austin’s accomplances, 18-year-old Skyler Shane Townsend, of Orange Park, was shot by the victim on Nov. 17, 2020, on the 1100 block of Center Street.
Austin posted photos of guns on social media and the victim, friend and family member responded. After Austin was paid, he sent the victims to a spot to pick up the guns, the State Attorney’s Office said. When they arrived, one of the attackers fired two shots with an AR-type rifle. Somebody in the victim’s entourage returned fire and struck Townsend.
The case was investigated by the Green Cove Springs Police Department and was prosecuted by Assistant State Attorneys Randi Daugustinis and Hector Murcia-Bustos.
Austin also was charged with battery in the county jail after Clay County Sheriff’s Office Detention Deputies said he joined Bernard Reese, Kyle Randelston, Deshaun Green and Qwentin Simmons in a brutal attack of another inmate, Dontae Reid, on March 10.
Also, charges were dropped against Austin following another three-on-one jailhouse attack on March 14, 2022.

Man in jail for trafficking meth after being released from prison

KEYSTONE HEIGHTS – A traffic stop for an expired tag led to the eventual arrest of a Starke man for trafficking in methampheatime.
Rosalio Hernandez Rios, 39, was charged with trafficking after a sheriff’s office K-9 alerted deputies of the likely presence of illegal narcotics during a traffick stop on April 27.
A search uncovered 17.7 grams of methamphetamine, along with two glass pipes, 3½ buprenorphine pills, two boxes of suboxone strips, 8.6 grams of marijuana and a digital scale. Rios told deputies he had just been released from prison.
Rios’ bond was set at $256,260. His next hearing will be on May 30.

Brother, sister arrested for resisting, obstructing CCSO investigation

ORANGE PARK – A man who yelled expletives at Clay County Sheriff’s Office deputies and refusing to leave a roped off crime scene while they were investigating a burglary call wound up going to jail, too.
Ricardo Miguel Andino, 18, of Orange Park, was charged with corruption by making threats to a public servanct and obstructing law enforcement when he tried to stop deputies from arresting his sister, Raquel Nicole Johnson, 27. After Andino moved his car at the apartment complex, he walked under the yellow police tape and refused to leave.
His bond was set at $6,505. Johnson was arrested for resisting and obstructing law enforcement. He bond was set at $1,502.

Orange Park Athletic Association softball coach indicted for child porn

JACKSONVILLE – U.S. Attorney Roger B. Handberg announced the arrest and the return of an indictment charging Andrew Lynn Overheul, 43, of Orange Park, with six counts of producing and attempting to produce child sexual abuse files. If convicted, Overheul faces a minimum mandatory 15 years, up to 180 years, in federal prison. The indictment also notifies Overheul that the United States intends to forfeit electronic devices used in the commission of the charged offenses. Overheul will be detained pending a trial scheduled for the June 2023 trial term.
An indictment is merely a formal charge that a defendant has committed one or more violations of federal criminal law, and every defendant is presumed innocent unless, and until, proven guilty.
This case was investigated by the Clay County Sheriff’s Office, Homeland Security Investigations and the Northeast Florida INTERCEPT Task Force. It is being prosecuted by Assistant United States Attorney Kelly S. Karase.
The case is brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by the United States Attorneys’ Offices and the Criminal Division’s Child Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute individuals who sexually exploit children, and to identify and rescue victims. Orange Park man convicted of firing sawed-off shotgun

JACKSONVILLE – Dylan Milton Jarvis, 31, of Orange Park, has been found guilty of unlawful possession of an unregistered National Firearms Act firearm (sawed-off shotgun), following a bench trial. Jarvis faces a maximum penalty of 10 years in federal prison and forfeiture of the sawed-off shotgun seized by law enforcement during their investigation. The case is set for sentencing on July 24.
According to court documents, at approximately 5:30 p.m. on January 11, 2022, deputies from the Clay County Sheriff’s Office responded to calls of shots fired near Blanding Boulevard. Eyewitnesses in the area described an individual, later identified as Jarvis, carrying a shotgun and firing multiple rounds. Upon making contact with Jarvis in a parking lot, the deputies determined that Jarvis had fired three to four shells from a Harrington & Richardson 12-gauge shotgun and then discarded the firearm. The deputies located the shotgun in the immediate vicinity of the parking lot along with multiple spent shotgun shells.
During an interview with the CCSO, Jarvis admitted to illegally modifying the shotgun. Follow up investigation by the CCSO and the Bureau of Alcohol, Tobacco, Firearms and Explosives determined that Jarvis had previously sawed off the barrel and the stock of the 12-gauge shotgun. A record check confirmed that this sawed-off shotgun was not registered to Jarvis in the National Firearms Registration and Transfer Record, as required under federal law.
The case was investigated by the Clay County Sheriff’s Office and the Bureau of Alcohol, Tobacco, Firearms and Explosives – Jacksonville Office. It is being prosecuted by Assistant U.S. Attorney Kevin C. Frein. Assistant U.S. Attorney Mai Tran is handling the forfeiture of the sawed-off shotgun.

Middleburg man caught with child sexual abuse videos

JACKSONVILLE – Sam David Harris, Jr. ,37, Middleburg, was charged with possessing of videos depicting the sexual abuse of young children. If convicted, Harris faces a maximum penalty of 20 years in federal prison. Harris has been ordered detained pending trial.
